These terms govern your access to and use of the Surf website and platform. By using Surf, you agree to them.

By accessing or using Surf, you agree to these terms. If you use Surf on behalf of a company, you confirm that you have authority to bind that company, and “you” refers to that company.

If you do not agree to these terms, do not use the service.

Surf provides connected payroll, people and intelligence tools, including workflows supported by AI assistance. Product screens and examples shown on our website are illustrative and demonstrate how the product presents information for review; they are not commitments that a specific result, filing or transfer will occur.

We may improve, change or add features over time. We do not provide legal, tax or accounting advice; outputs such as payroll summaries and tax preparation views are for your review before use.

You must provide accurate account and business details and keep them current. You are responsible for safeguarding your credentials and for activity under your account, and you must tell us promptly about unauthorized use.

Accounts are for business use. You must be old enough under applicable law to form a binding contract to use the service.

You may use the service only for lawful purposes. You must not interfere with or disrupt the service, access it through unauthorized means, reverse engineer it except as the law allows, or use it to violate laws that apply to you, including laws governing employment, payroll and tax information.

You keep all rights to the data you provide. You give Surf a limited license to process that data as needed to provide and support the service, including storage, processing and security. You are responsible for the accuracy and completeness of the payroll and people information you provide.

We may use aggregated or de-identified information to operate, secure and improve the service. When the law permits, we will de-identify information before such use.

Plans, prices and included features are described on our Pricing page. Fees are billed on the schedule shown at checkout or in your order, and stated amounts exclude taxes unless noted, which are your responsibility where applicable.

If we change pricing for your plan, we will provide advance notice before the change applies to you.

You can stop using the service in line with your plan. We may suspend or end accounts that breach these terms or that create legal or security risk for Surf, its users or providers.

When an account ends, we will make your data available for export on request, subject to legal retention requirements, and then delete it in line with our data retention practices.

The service is provided as evolving software. Except as stated in these terms, Surf disclaims other warranties to the fullest extent the law allows, including warranties of merchantability, fitness for a particular purpose and uninterrupted or error-free operation.

To the maximum extent permitted by law, Surf is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, even if advised of the possibility. Our total liability for claims relating to the service is limited to the fees you paid us in the twelve months before the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You will defend and indemnify Surf against claims, damages and reasonable costs arising from your use of the service in violation of these terms or from data you provide in violation of the law or others’ rights.

These terms are governed by applicable U.S. federal and state law, without regard to conflict-of-law rules. Disputes will be handled in the courts or forums with jurisdiction over the parties as applicable law provides.

We may update these terms as the service changes. We will post the updated terms on this page and revise the last-updated date above. Continuing to use the service after changes take effect means you accept the updated terms.
